Privacy Glossary

According to the present statement we want to inform you that the data subjects/site users personal data provided with to Across Bergamo through the present site communication tools will be processed in respect to the processing definition contained in the art.4 of the new RGPD (look at the privacy glossary)

1) Data Controller

2) Legal Grounds, Purposes and Means of the Processing

The present site contains two points for the data subject/site user personal data collection: the email address marked in the section “contacts-us” and the Void-Labs-Snc-Managed voxmail service for the creation and sending of tailored-made newsletters. Void Labs Snc headquarters are in Faenza (RA).

In the first case, the personal data of the data subjects/site users are processed by the controller for the specific purpose to activate and manage the relationship between the two of them and they are freely given by the data subjects who want to contact the controller (legal ground: the freely-given, specific, unambiguous and informed consent). The personal data may also be used by the controller to send commercial and marketing messages within the scope of the commercial or even contractual relationship according to art.13.2 of the Directive 2009/136 (legal ground: the controller’s legitimate interest to develop and consolidate the business relationship with the data subject/user). In the second case, the personal data of the data subjects/users are processed by the controller with the purpose to manage a newsletters service. These data can be released either by the data subjects/users who freely decide to subscribe to the service or may be introduced into the newsletter database by the controller always in compliance to the data subjects/users’s freely-given, informed, specific and unambiguous consent (legal ground: the consent).

As an ancillary service to the newsletter, the Voxmail platform makes it possible to verify which messages have been opened, and the clics on the links present in the newsletter text, together with details regarding the IP addresses and the browser/device used. The collection of these data is fundamental to the processing implicit renewal and an essential part of the platform functioning.

Each data subject/site user who receives Bergomum, the Across Bergamo newsletter, has always the power to freely withdraw his/her consent to the personal data processing thanks to the specific unsubscribe function present in the newsletter text.

3) Recipients

The data subject/user’s personal data collected through this site (together with the other data necessary to communicate with the same subjects and directly obtained from them via email), may be transmitted to other tourist guides (autonomous data controllers) in case of outsourcing of the tour guide service (because of the controller impossibility to carry out the service) with the exclusive purpose di give way to the tour guide request.

As explained in the point 2, the personal data to be processed may be introduced in the Voxmail newsletter database: under this respect and limited to it, Void Labs Snc is an external data processor according to art. 28 of the GDPR.  

In order to comply with the legal obligations set forth in the tax laws and regulations or for the establishment, exercise or defense of legal claims (also through ADR methods), the personal data contained in invoices or in contracts, will or might be transferred to the professionals related to the indicated purposes (accountants and lawyers).

4) Personal data communication

The personal data collected through the present site and the ones communicated afterwards during the commercial talks are necessary for information exchange between the parties and the carrying out of the service by Across Bergamo. The denial of the data use hampers the Across Bergamo capacity to give present and future tourist services.  

 5) Period of retention

The personal data collected through this site points of contact (and used to manage the business relationship with the data subjects/users) are periodically updated. In case of personal data contained in legal or fiscal documents, they will be stored for a 10-year period. In case of data used for direct marketing purposes, it will be retained as long as the data subject/user doesn’t exercise his/her right to object or as long as his/her previously-given consent isn’t denied.

7) Cookie policy

The information about the use of cookies is provided pursuant to the provision of the Italian Competent Authority 05/08/2014 "Identification of simplified procedures for the disclosure and acquisition of consent for the use of cookies".

7.1) What are cookies what they are useful for

Cookies are pieces of information (small text strings) introduced in your pc through your browser when you visit a website. 7.3)  Communication social network (social networks) buttons and widgets

Social buttons are icons on the site that depict social network icons (e.g. Facebook, Linkedin, Youtube and Twitter) and allow users who are browsing to directly interact through a "click" with these social platforms. Technically these are links that refer to the account of the depicted social-network owner. By using these buttons, therefore, third-party cookies are not installed on the site.
